The following terms and conditions stand for all classes, pole functions, pole parties, and lessons conducted by “Taija Kemp” T/A “Pole Fit Mackay”, and it's instructors, (“We”, “Ours”, “Us”, “Instructor”, “Instructors") as well as use of our venues, studio, and equipment. This also includes but is not limited to all other related entities, event promoters, landlords, or venue staff.
By attending classes, lessons, parties, functions, or events you agree that you have read,
understood and agreed to comply with the terms and conditions outlined below.
HEALTH AND SAFETY
It is your legal responsibility to advise us of any existing medical conditions or injuries and also to inform us of any changes. Some manoeuvres can be more challenging and/or carry more risk than others. Students must always follow the directions of instructors and venue staff. At no time may a student or guest attempt to execute a move that they have not been taught by us, except where expressed permission is given. You should always consult your doctor before starting any new exercise regime.
INJURIES AND RECOVERY
The risk of injury is a possibility with any physical activities you partake in. Should you encounter an injury during your participation in an event or lesson, you agree to inform an instructor immediately and fill out an injury report. It is advised that you then seek medical attention and cease any future lessons until you have consulted your doctor regarding the injury. Serious injuries may require weeks or months of healing and rehabilitation and it is your responsibility to ensure you have fully recovered and have a doctor’s approval before returning to lessons. A doctor’s certificate may be required before being allowed to return to lessons.
ASSUMPTION OF RISK
As with any sport, pole dancing can carry the possibility of risk of harm. Attendance of and participation in classes and all related studio events, or any use of our studio, function venue, or equipment, is at your own risk. You voluntarily make and grant this waiver of liability and assumption of risk in favour of Pole Fit Mackay, its Instructors, related entities, or use of our studio, any area, and equipment. You hereby waive and release any and all claims whether for personal injury, property damage, damages, loss, and/or death that may arise from your participation in/on aforementioned event/s. You accept, assume and undertake the risk and agree to use your best judgement and to abide by all safety instructions and recommendations whether oral or written. You assume these risks of your own free will being under no compulsion or duress. This waiver of liability and assumption risk may not be revoked or amended without prior written consent.
All classes, practice times, and functions require pre-payment in full prior to attending. Payment details are provided on our website and must be completed immediately after registering for a class. Products, equipment, or merchandise purchased require payment in full prior to receiving the item. Special order items require pre-payment before item is ordered. Prices are subject to change at any time without notice. Payment plans and discounts may be available, please contact us discuss your options.
In the event you need to cancel or reschedule a class you have registered for, you MUST provide a minimum of 12 hours’ notice. In the event a class is cancelled, or you are unable to attend and have provided more than 12 hours’ notice, a credit to your account will be applied for future use. Credits may go towards future classes, products, merchandise, or equipment for sale. All credits have an expiry - please check your email receipt for expiry date. Failure to provide a minimum of 12 hours’ notice will result in the forfeit of your pre-payment. This is strictly enforced to ensure fairness to other students and our instructors.
REFUNDS & RETURNS
If a class is cancelled, or you are unable to attend and have provided sufficient notice, you will automatically receive an account credit. We do not issue refunds, however if you are unable to attend due to medical reasons you must notify us BEFORE your passes expire. You MUST provide a valid medical certificate in order for us to extend this courtesy to you. This is done so at our discretion and is not an entitlement. We cannot issue refunds under any circumstances for expired passes. To cover our merchant fee’s, a small processing fee will apply to all refunds for classes. In the event you need to return merchandise, items must still be new, unworn, and have tags attached. If merchandise is faulty, please let us know so we can refer the matter to our supplier.
PROMOTIONS & DISCOUNTS
At our discretion, we may run promotions and discounts. All promotions and discount coupons may be altered, cancelled, or declined by us at any time without notice. Promotions and discounts must be redeemed by the expiration date noted on your email receipt or voucher.
CLASSES, OPEN STUDIOS, AND EVENTS
Classes and Events may be attended by existing students and new students. Poles may be shared by multiple students, depending on class numbers. Class size may be capped and classes may be subject to a minimum number of students to be scheduled. Open studios can be attended by existing and new students and are offered as practice time. Open studios may or may not include instructor supervision. This is not as a class or lesson where the instructor will be teaching. Students must meet a minimum required skills assessment to progress to a more advanced ‘level’. Students are promoted to a ‘higher’ level at instructor discretion. Completing a lesson does not entitle the student to progress to the next level of teaching. Students will advance through the levels at varying rates. Students under the age of 18 must have consent from a parent/guardian to participate in classes or events.
All lesson and class content, choreography and routines, taught or performed in classes, functions, one on one lessons, pole parties, or performances remains copyright to Pole Fit Mackay. It may not be reproduced in full or in part, for the purposes of instructing others, self-promotion, performance of any kind, or for personal financial gain or profit or on behalf of others without written permission. You grant us the right to use your image, while taking part in any of my lessons or event, for promotional or commercial purposes for Pole Fit Mackay or its Partners.
CLASS AND STUDENT CONDUCT
It is important for students to be punctual to every class/lesson. Please allow extra time to find parking, get changed, pay for classes etc. Classes will not be delayed to wait for any participants. For your own safety, never participate in classes, pole parties, or events while under the influence of drugs or alcohol. Students will not be permitted to participate in a class or event if the instructor/manager believes they are under the influence of drugs and/or alcohol. Glass is not permitted in the pole studio area. All breakages/spillages must be reported to an instructor or staff immediately. Students must sign a waiver prior to participating in any lessons or events. Students must not use the poles or other equipment, if they have not signed a waiver. Never attempt any moves outside your skill level without my permission and/or supervision. You must have a spotter if you are not fully confident in attempting a move. All students must participate in a full warm up and/or stretch prior to class, for their own safety. Late students are responsible for their own warm up. Jewellery (rings, bracelets, necklaces, large earrings, etc), is not permitted during class or other events, to avoid injury and to ensure our poles are kept in good condition. Appropriate dance/fitness attire must be worn at all times during classes. It is recommended you wear gym shorts or hot pants and sleeveless tops, crop tops or sports bra’s. Oily moisturizers are not permitted in class, for the safety of all students and instructors. Please treat all students & instructors with respect and courtesy, at all times.
AUSTRALIAN CONSUMER LAW
Under the Australian Consumer Law (‘ACL’), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that Pole Fit Mackay is required to ensure that the recreational services it supplies to you:-
are rendered with due care and skill; and
are reasonably fit for any purpose which you, either expressly or by implication, make known to Pole Fit Mackay; and
might reasonably be expected to achieve any result you have made known to Pole Fit Mackay.
You agree that your rights to sue the supplier under the ACL if you are killed or injured because the services provided were not in accordance with these guarantees, are excluded, restricted or modified in the way set out in these terms and conditions.
It is recommended you revisit our T&C’s regularly to review any changes. Students, members, or guests found breaching any of the above terms or conditions may be required to leave the lesson, class or event either temporarily or permanently, with no refund.
